Personal injury law is an area where you may notice significant television and internet advertising. Typically, personal injury law firms work on the concept of mass production. In other words, the more cases they attract to their firms, the more likelihood of a return on all the advertising they generate. The reason is simple: personal injury firms typically charge you for all the costs and then a percentage on the gross settlement award. For example, a personal injury award of $100,000 will net you much less than that amount using the typical personal injury firm math. Assuming costs of $10,000 and the fee of 33% (that is $33,000!) as an injured person you might expect to receive a sum of only ½ of what you were awarded. That is assuming you have chosen a good firm. Your recovery can be even less if the attorney charges a higher percentage fee or the case goes to trial.
Also, you need to have constant contact with the attorney handling your case. You are likely not versed in legal procedures and how these firms work. It is extremely important to make sure you utilize a firm where there is attorney contact with your file. Too many times we hear of clients who use firms advertising “800” phone numbers or slick advertising campaigns where they will never speak with an attorney; rather, they deal with non-attorney personnel, such as administrative or clerical staff. This can be very frustrating when you merely have a legal question or want a status update on your case.
